A meeting of Hartington Nether Quarter Parish Council was held at 7.30 pm on Monday, 4th July 2016, at Biggin Village Hall.
Present: Mr D Prince, Mrs J Brindley, Mrs J Bonsall, Mrs S McCurrach (Part of the meeting) and the clerk, Mrs S Hampson. There were no members of the public in attendance.
Part 1 – Non-confidential information, to consider:
16.7.1 Apologies
Apologies had been received in advance of the meeting from Mrs J Coles and Mrs J Griffiths.
16.7.2 Declaration of personal/prejudicial interest of councillors
There was no need, by any member present, to complete an entry in the register.
16.7.3 Minutes of the previous ordinary meeting
The minutes of the previous ordinary meeting had been forwarded to members in advance of the meeting; displayed on the parish council noticeboard and on the parish council’s website.
Resolved: These were accepted as a true copy of proceedings (Prop JB Sec JB)
16.7.4 Matters arising from pre-meeting
Derbyshire Dales District Council (DDDC) had checked with Waste Services and they had not removed the bin from near the village hall nor damaged it. Following the request from the clerk for a replacement bin and in view of DDDC having previously removed several waste bins from the parish, DDDC has replaced the missing bin at the Village Hall. DDDC will also arrange for the relocation of the bin on Main Street as requested.
Peak District National Park Ranger Service had also replied to the clerk regarding bins on the Tissington trail. The Ranger advised that the officer mentioned in the previous minutes was referring to the waste bins at their car parks only, so the nearest Peak District National Park Authority (PDNPA) bins to Biggin are on car parks at Hartington and Alsop. They do not provide bins away from car parks and expect dog owners to be responsible for clearing up after their pets.
16.7.5 Public speaking procedures document

The PCSO was not in attendance.
16.7.8 County Councillor and District Councillor updates
Neither councillor was in attendance.
16.7.9 Highway issues including Cardlemere Lane
Derbyshire County Council (DCC) had apologised for the delayed response regarding erecting the advisory weight limit sign at the end of Cardlemere Lane; however, all being well, this sign should be erected shortly. DDDC had requested further information regarding the flytipping which has taken place on Cardlemere Lane including:
- the location of the current fly tip (grid ref) or is it easily visible as you drive along the lane?
- how many times and over what period have the previous fly tips occurred?
- did anyone witness the material being dumped and have a registration plate?
If it is builders rubble and does not include domestic waste or labelled boxes it is unlikely that any personal details will be found and DDDC will not be able to take action against those responsible, unless there is a witness. If the tips occur in the same place, DDDC could consider installing mobile CCTV but would need the above evidence (frequency and location) to apply to the court for RIPA authorisation. If the rubble is on the highway or verge then DDDC will remove it but if it is on private land it is down to the landowner. Some signage could be put up.
The members discussed the requests from DDDC.
Resolved: The clerk to provide further comments from the members regarding the flytipping including that some of the waste tarmac has yellow lines on it. Registration details of the vehicles seen on Cardlemere Lane have not been recorded.
From the previous meeting, DCC had responded to the clerk with regard to the visibility at Washmere Corner. The Highway Inspector has advised that DDDC cut the verges at this location and therefore, DCC passed the request onto them and asked that they arrange for the verge to be cut back. The clerk had also reported the end of the Liffs junction with A515 regarding poor visibility.
Members commented that the verges from Main Street up to the A515 need to be cut back.
Resolved: The clerk to contact DDDC to request Main Street verges from near the bridge to A515 to be cut back.
DCC had provided information regarding a temporary road closure on Mouldridge Lane, Pikehall and a temporary 30mph speed limit on A5012, Pikehall for the YNot Festival.
16.7.10 Planning applications and planning sub-committee
A new planning application had been received for a single storey extension and fire escape at the Jug and Glass Inn. Members spent a considerable amount of time discussing the merits and issues with this application, including health and safety requirements and the visual impact of the extension and fire escape from the road.
Resolved: The clerk to advise the case officer that the parish council supports the element of the application at the Jug and Glass concerned with the fire escape from staff accommodation but does not support the element for almost doubling the size of the porch. The rationale behind disagreeing with the proposal to extend the porch was based on the door being replaced by a window effectively reducing ground floor escape facilities.
The clerk advised that the application for the muck pad and new road at Newhaven had gone before the planning committee at Peak District National Park Authority but she had not yet been made aware of the outcome.
The proposal to remove condition 3 at Porridge Lane had been granted.
16.7.11 Village seat maintenance
The groundsperson had advised that the memorial seat in the cemetery had been returned following preservation works. He will also maintain the seat on Drury Lane but in the meantime, Mr Prince advised that he had attended to the village seat on Drury Lane.
Members also discussed the seats at Heathcote Mere and placing advisory signs on these in an attempt to prevent parking on the grass. Mrs Coles had liaised with a local sign company regarding this and a design had been forwarded.
Resolved: To order and implement the placement of advisory no parking signs on the benches at Heathcote Mere.
16.7.12 Public telephone box at Newhaven
Personnel at British Telecom had advised the clerk that the interested party from the Newhaven Garage could contact them directly regarding the possible provision of a public phone box. BT further advised that other telecommunication providers may offer a similar service.
Resolved: Mrs Bonsall to provide the interested party with the contact detail provided to the clerk.

Further communication had been received from the Pension Regulator regarding a declaration of compliance. The clerk had also received confirmation that the VAT claim had been successful and the sum of £40.30 would be credited to the council’s bank account. shortly.
16.7.14 Village pavements
The clerk had not received any further information and Mrs Griffiths was not in attendance to advise if any contact had been made directly. Members reported that the worst areas of the pavement are where they have been lowered for entrances to people’s drives and the stretch from the village hall to the church corner.
16.7.15 Former POW camp
The clerk had emailed Bagshaws further and an acknowledgement had been received; however, there was no reply received in time for the meeting.
16.7.16 Cemetery application and mowing
The groundsperson had advised that the perimeter of the parish council cemetery has now been strimmed. The reason it was left was due to the daffodils being left to die back of their own accord to build up their resources for the following year. He had asked the clerk to advise him as he considered this to be the same issue every year. He required clarification whether to leave daffodils to die back of their own accord or strim them straight off after they have finished flowering? He also asked which verges are not cut back to the wall?
Resolved: to advise the grounds person of the members’ decision regarding the dead daffodils.
The clerk had contacted the monumental mason to make a sample of the paradiso granite available to enable members to approve/disapprove a memorial application. The sample had arrived just in time for the meeting. Members considered the sample very carefully together with additional images.
Resolved: to not accept paradiso granite in the parish council cemetery due to uncertain pink colouration; the parish council’s rules state grey or black granite and the precedent this may set to allow any other variation of stone.
Resolved: the clerk to advise the monumental mason accordingly.
Mr Prince asked members of the parish council to consider approval of another memorial seat in the cemetery, at the side of the existing seat.
Resolved: To approve the placement of a second memorial seat in the parish council cemetery.
16.7.17 Policy document review and standing orders
The clerk advised members of an additional paragraph to be inserted in to the parish council’s standing orders regarding the award of contracts.
Resolved: to insert the additional paragraph in the council’s standing orders and place on the website.
The clerk also queried references in model financial regulations regarding three year budget review and members checking the accounts to bank statements.
Resolved: To remove the reference to a three year budget review.
16.7.18 Transparency fund application
The clerk advised that a submission for a new laptop and scanner was with DALC for onward submission.
16.7.19 Correspondence and electronic communication
Included:
DDDC Area Forums, DALC circulars and a response from DALC regarding a recent enquiry from a member of the public requesting a second public speaking session within meetings. DALC state that these are meetings of the Parish Council, and members of the public, although invited to attend, are only to speak at specific point(s) during the meeting, have no jurisdiction over how the meeting is conducted, or what items are on the agenda. Also during these sessions members of the public can speak, but they have no right to an answer and the council can just note what is said. – the councillors are entirely responsible for what is on the agenda and not answerable to any other authorities in the carrying out of their business).
DDDC state that owners are only required to have their dogs on a lead if the area has been registered with a Public Space Protection Order. All dogs on or off a lead need to be under control.
Hearing Help UK advised the clerk that in order to provide the parish council with the information needed regarding a hearing loop for the village hall they would need to make a site visit to assess the size and layout of the hall, p.a. facilities etc then a quote can be provided for the size of loop system required and how long installation would take. Members were asked if there is a day when it would be best to meet with the representative?
Information was also provided from a Government Publication relating to the Disability Act 2010 which is a Disability Quick Start Guide. Further information was taken directly from the Act itself.
Resolved: Mrs Bonsall to act as the liaison contact for the parish council.
Resolved: The clerk to contact the village hall committee with the up to date information and to request a mutually convenient appointment.
